These Terms of Service ("Terms") govern your access to and use of the Igiari! website, API, and related services (collectively, the "Service") operated by the owner of Igiari ("we," "us," or "our"). Please read these Terms carefully before using the Service.
By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
Igiari! is an automated tool that analyzes pasted text for possible logical fallacies using artificial intelligence. The Service is provided for general informational and educational purposes only. It is currently offered free of charge and does not require user accounts.
We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We do not guarantee uninterrupted availability, specific response times, or continued free access.
2. No Professional Advice
The Service does not provide legal, academic, journalistic, medical, financial, or other professional advice. Output from the Service reflects automated pattern matching and probabilistic AI analysis, not human judgment. You are solely responsible for how you interpret and use any results.
Do not rely on the Service as the sole basis for decisions that could affect rights, grades, employment, publication, litigation, public statements, or other significant outcomes. Consult qualified professionals where appropriate.
3. AI Limitations and Accuracy
You acknowledge and agree that:
- AI-generated results may be incomplete, inaccurate, misleading, or inconsistent.
- The Service may fail to detect fallacies that are present (false negatives) or flag reasoning that is not fallacious (false positives).
- Fallacy labels and explanations are heuristic summaries, not definitive classifications.
- Results may vary for the same or similar input over time as models, prompts, or infrastructure change.
We make no representation or warranty that any scan result is correct, exhaustive, or suitable for any particular purpose.
4. Eligibility and Acceptable Use
You must be at least 13 years old to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian.
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Submit content you do not have the right to submit, or content that infringes intellectual property, privacy, or other rights of any person or entity.
- Submit malware, spam, or content intended to disrupt, overload, or compromise the Service or third-party systems.
- Attempt to bypass rate limits, access controls, or security measures.
- Reverse engineer, decompile, disassemble, scrape, copy, or systematically extract the Service, its source code, prompts, models, designs, or underlying software, except where such restriction is prohibited by applicable law.
- Use the Service to harass, defame, threaten, or harm others, or to generate or disseminate unlawful material.
- Represent AI-generated output as human expert review or as guaranteed fact.
- Use the Service in a manner that violates the terms or policies of our third-party providers, including Anthropic.
We may investigate violations and restrict or terminate access at our sole discretion.
5. Your Content
You retain ownership of text you submit. By submitting text, you grant us a limited, non-exclusive, royalty-free license to process, transmit, cache, and display that text solely as necessary to operate and improve the Service, including sending it to our AI subprocessors.
You represent and warrant that you have all rights necessary to submit the content and that your submission and our processing as contemplated by these Terms do not violate any law or third-party rights.
You are solely responsible for the content you submit and for any consequences of submitting it, including disclosure to third-party AI providers as described in our Privacy Policy.
6. Intellectual Property
Except for content you submit and except for third-party materials, the Service — including its design, branding, text, software, source code, prompts, backend implementation, and compilation of fallacy reference material — is proprietary and is owned by us or our licensors. It is protected by copyright, trade secret, trademark, and other laws. See our Copyright Notice and the repository LICENSE for more detail.
No ownership or intellectual property rights are transferred to you. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the public web interface of the Service for personal, non-commercial purposes only. You may not copy, download, modify, or reuse the Service's software, code, prompts, or proprietary materials.
7. Third-Party Services
The Service depends on third-party infrastructure and AI services. Your use of those services through Igiari may be subject to separate third-party terms. We are not responsible for third-party services, their availability, or their acts or omissions.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that the Service will be error-free, secure, uninterrupted, or free of harmful components, or that results will meet your expectations.
Some jurisdictions do not allow exclusion of certain warranties, so some of the above exclusions may not apply to you.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Because the Service is currently free, clause (B) will often be zero.
These limitations apply to all theories of liability, including contract, tort (including negligence), strict liability, and any other legal theory.
Some jurisdictions do not allow limitation of incidental or consequential damages, so the above limitation may not fully apply to you.
10. Indemnification
You agree to defend, indemnify, and hold harmless us and our officers, directors, employees, contractors, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) content you submit; (c) your violation of these Terms; or (d) your violation of any law or third-party rights.
11. Dispute Resolution
Before filing a claim, you agree to try to resolve the dispute informally by contacting us as described in Section 14 and allowing at least 30 days for a response.
These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your jurisdiction provide otherwise.
Except where prohibited by law, you agree that any dispute not resolved informally will be brought exclusively in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.
Nothing in these Terms limits rights that cannot be waived under California law, including certain consumer protections.
Class action waiver: To the extent permitted by law, you and we agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
12. Future Paid Features
The Service is currently free. If we introduce paid features in the future, additional payment terms may apply. We will not charge you without presenting applicable terms and obtaining any consent required by law.
13. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top indicates when they were last revised. Material changes will be posted on this page. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
14. Contact
For questions about these Terms, contact us at jamescarson3rd@gmail.com (subject line: Legal Notice).
15. Miscellaneous
- Entire agreement: These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Service.
- Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
- No waiver: Failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment: You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Survival: Sections that by their nature should survive termination will survive, including disclaimers, limitations of liability, indemnification, and dispute provisions.
